In this Privacy Policy (“Policy”), we describe how we collect, use and disclose information that we obtain about visitors to our website (the “Site”) and the applications and services we make available through Remotely Close™ (the “Services”).

By visiting our Site or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and our Terms of Use at www.remotelyclose.com/terms-of-use.html, including its applicable limitations on damages or the resolution of disputes. Our Terms of Use are incorporated by reference into this Policy.

By using our Services you understand and agree that we are providing a platform for you to post content, including photos, videos, locations, messages, comments, and other materials ("User Content"), to the Service and to share User Content with specific users and groups of users you select.

Information We Collect About You

You are under no obligation to provide us with your information, but this may prevent you from using all or certain parts of our Site and/or Services.

We may collect information about you directly from you and from third parties, as well as automatically though your use of our Site and/or Services.

Information We Collect Directly from You

The information that we collect from or about you depends on your interaction with our Site and/or Services. In addition, we require you to register with us to use certain areas of our Site or to use our Services. To register you must provide certain information which includes your email address and a name to represent you in our Services. You will need to use an email address and password that is unique to you. In other areas of our services we allow you to add additional information about you and your family members, which include gender, date of birth, and phone number (these are all optional). In future releases we will provide features that allow you to celebrate birthdays and refer to members in the proper gender. Phone numbers would be used with permission to send text messages to those phones or automated voice messages.

We collect User Content (e.g., photos, videos, comments, and other materials) that you directly post to the Services, as well as information about your family members that you configure in our Services. You are always in control of how your User Content is shared with other users in our Services by managing which families you belong to and which members and families you explicitly shared your User Content with in our Services.

Information We Collect from Others

In some cases, your family member, response team, or healthcare provider may register you. We will only ask for the data required to register you. This may include your email address or special identifier known by you and the third party in order to link your Remotely Close account to the provider.

Information We Collect Automatically

We may automatically collect information about your use of our Site and/or Services through cookies and other technologies: your domain name; your browser type and operating system; webpages you view; links you click; your IP address; culture code; timezone; the length of time you visit our Site and/or use our Services; and the referring URL or the webpage that led you to our Site. Please see the section “Cookies and Other Tracking Mechanisms” below for more information. We use this information to track our website visitors for guaging the success of our marketing efforts. We track the actions you take within our Services in order to understand user behavior to make sure we identify opportunities to improve the usability of our Services.

How We Use Your Information

We use your information, including your personal information, for the following purposes:

    To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries and for other customer service purposes.

How We Disclose Your Information

WE DO NOT SELL YOUR PERSONAL INFORMATION, WE TREAT IT VERY CAREFULLY. However, we may disclose your information, including personal information, as follows:

  • Business Partners

    We may disclose the information we collect about you to business partners, who may use the information to provide services, market or advertise to you. The information will only be disclosed on a per partner basis and only with your explicit consent and authorization within our Services (separate from this privacy policy).

  • Service Providers

    We may disclose the information we collect about you to vendors, service providers, contractors, agents or other third parties who perform functions on our behalf, or for whom we provide services. For example, we use Google analytics to track website visitors, and by using their code in our website we are sharing information collected about you in order for us to view the analytics.

  • Business Transfers

    If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the other company.

  • In Response to Legal Process

    We may disclose the information we collect about you in order to comply with the law, a judicial proceeding, court order or other legal process, such as in response to a court order or a subpoena.

  • To Protect Us and Others

    We may also disclose the information we collect from you where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.

    In accordance with applicable laws and regulations, such as HIPAA, we may disclose aggregate or de-identified information about users with third parties for business purposes.

Cookies and Other Tracking Mechanisms

We use cookies and other tracking mechanisms to track information about your use of our Site and Services. We may combine this information with other information we obtain about you.

Do-Not-Track

Our systems do not recognize browser “do-not-track” requests, but we do not track you after you leave our Site. You may disable certain tracking as discussed in this section (e.g., by disabling cookies).

Cookies

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive or mobile device through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Services.

Disabling Cookies

Clear GIFs, pixel tags and other technologies

Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also known as web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We or our service providers may also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Third-Party Analytics

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site. We also may use other analytic means to evaluate our Site and Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services.

Third-Party Links

Our Site and/or Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

Security of My Personal Information

We have implemented precautions to protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password and device by, among other things, signing off after using a shared computer or device, choosing a robust password that nobody else knows or can easily guess and keeping your log-in information and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Additionally, we cannot control the actions of third parties with whom you may choose to share the data collected using our Services, including your Authorized Users. Therefore, we cannot and do not guarantee that your information will not be viewed by unauthorized persons. To the fullest extent permitted by law, Newyu and its respective officers, employees, agents, representatives, volunteers, assigns, transferees, and licensors and developers (collectively “Affiliated Parties”) are not responsible for, and you hereby release us and our Affiliated Parties from any liability which may arise from, such third parties’ unauthorized collection of your information.

Access to My Personal Information

You may modify information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Services and/or Site for a period of time.

Marketing Communications

We may send periodic promotional or informational emails to you. You may opt out of such communications by clicking links at the bottom of the emails to unsubscribe or updating your account settings. Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us.

Transfer of Data to Other Countries

We may store and process your information collected through our Services in our offices and/or in the offices of service providers located in the United States or other jurisdictions where we may have operations. Our Services are operated using generally available hosting providers.

We host our software with nationally recognized leaders in cloud computing infrastructure, chosen because of their track record of offering trusted service. These vendors have obtained many certifications and third party attestations including SAS70 Type II, PCI DSS Level, ISO 27001, and ISO 27001, among others

All users

You understand and agree that your information may be subject to foreign laws and that it may be accessible by foreign governments, courts, law enforcement and regulatory agencies.

Special Information for California Consumers

California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us at: privacy@newyu.com. Please allow up to thirty (30) days for a response.

Children Under 13

We do not knowingly collect personally identifiable information from children under 13. Parents must explicity create accounts to represent family members under the age of 13 to enable certain family-related features of our services. We do not allow the collection of email addresses or phone numbers for children under 13, but we do allow for the collection of a name to refer to them within the Service , and optionally date of birth, gender, and profile photo. Family Organizers and parents are able to remove these child accounts from our Services at any time.
